General Conditions of Use of the Loyalty Club

GENERAL CONDITIONS OF SALE AND USE
FROM THE “ADELINE KLAM CREATIONS PARIS LOYALTY CLUB (AKCP)”

Conditions in force and applicable on July 20, 2017 with the “Loyalty Program”, modified on September 18, 2024 in its new “Loyalty Club” version

The “Adeline Klam Loyalty Club” (hereinafter, “the Club”, also called “loyalty program” or “loyalty account”) is managed by the company Adeline Klam Créations Paris (AKCP) SARL with capital of €120,000, registered with the PARIS Trade and Companies Register under number 511 442 063, whose registered office is located at 54, boulevard Richard Lenoir 75011 PARIS. These general conditions are subject to French law and define the conditions of participation in the Club.

The Club allows its beneficiaries to accumulate points for each purchase made in the Adeline Klam boutique, located at 54, boulevard Richard Lenoir, 75011 PARIS, and on the website www.adelineklam.com , and obtain benefits in the form of discount codes or vouchers.

Any registration with the Club implies unreserved acceptance of these general conditions.

The operation and conditions of the Club are described below:

ACCOUNT - Registration with the Club allows the beneficiary to open an account
loyalty in the “Adeline Klam” store (hereinafter “the Account”). This Account is
strictly personal.

Opening an Account and joining the Club are reserved exclusively for
individuals, natural persons. The Account allows us to reward the loyalty of a registered individual, by giving them benefits related to their purchases in the store, in the forms and conditions described in these general conditions.

AKCP reserves the right to delete any account and any benefits acquired within the Club, without notice or compensation of any kind, if it turns out that the account was opened by a professional, a legal entity or for commercial purposes of any kind. This deletion will be made, moreover, without prejudice to the damages that AKCP reserves the right to claim in the event of use of the Account and/or the Club not in accordance with these conditions.

LOYALTY CLUB PAGE: LOGIN AND REGISTRATION - The dedicated Loyalty Club page allows customers to easily register for the loyalty program and log in to their account to access all the services offered.

It provides a clear and structured overview of available missions and programs, allowing customers to track their progress. Once registered and logged into their account, users can view their points balance and quickly access the following information:

  • points: balance of accumulated points,
  • missions: number of missions validated,
  • rewards: number of rewards obtained,
  • and sponsorships: number of sponsorships validated.

Customers will also have access to their referral link, making it easier to share and invite new referrals.

POINTS - The Account allows the Club beneficiary to accumulate points at
each purchase made in the “Adeline Klam” store or website.
One (1) euro of purchase gives rise to the registration in the beneficiary's Account of one (1) loyalty point. Points are earned throughout the year on products purchased in store or on the Adeline Klam website.

PROMOTIONAL CODE - When the beneficiary's cumulative purchases reach the threshold of 200 points during the same 12-month period following the date of membership or following their anniversary date, the beneficiary of the Account benefits from a promotional code for a 10% discount (excluding shipping costs) on a future purchase.

The promotional code will grant a discount on the total amount of items (excluding shipping costs) for a future purchase made in the “Adeline Klam” store or website; only one code can be used for the same purchase and excluding purchases made using “gift cards”. If the promotional code(s) or voucher(s) are not used during the same 12-month period, they will be lost, without any compensation. However, any excess points acquired during a 12-month period that are not sufficient to entitle you to a promotional code will be retained on the beneficiary’s Account and carried over to the following period.

Promotional codes cannot be refunded or exchanged for cash under any circumstances. Multiple promotional codes cannot be used for the same order, and discounts cannot be combined for the same order. Promotional codes cannot be used for purchases paid for with a gift card or gift code. However, promotional codes can be combined over the same period, allowing you to obtain the discount associated with each order on which the code is used. Promotional codes cannot be split.

REFERRAL - The referral program allows Adeline Klam store customers to recommend the loyalty program to their friends and family and benefit from advantages. To participate, the customer ("referral") invites a friend or relative ("referee") to sign up for the loyalty program. When the referee makes their first purchase in-store or on the website, they and the referee each receive a €10 voucher applicable to their next orders. The referrer can refer multiple referrals, but each referral can only generate the €10 benefit once.

The referral program is strictly personal and for non-commercial use only. It is prohibited to create multiple or fictitious accounts within this program. In the event of abuse or fraud, Adeline Klam reserves the right to exclude the participants concerned and cancel any benefits obtained. The program is also subject to applicable legal provisions regarding promotions and commercial benefits.

VOUCHER - Vouchers obtained through sponsorship are awarded when certain conditions are met, such as the registration of a godchild who has made their first purchase. Each voucher worth €10 (as part of the sponsorship) is valid only for a future purchase made in the Adeline Klam store or on the website. www.adelineklam.com .

The voucher will be deducted from the total order amount using a specific code. Vouchers cannot be refunded or exchanged for cash under any circumstances. They cannot be transferred to a third party and can only be used once. The voucher is non-divisible: if the purchase amount is less than the value of the voucher, the difference cannot be refunded or credited. Each voucher is valid for 12 months from its issue date. After this period, it will be canceled and can no longer be used.

MISSIONS - Loyalty Club members can complete various missions on their dedicated Loyalty Club page. These missions allow them to earn additional points upon successful completion, based on various specific actions. Missions can include activities such as attending events, posting reviews, or sharing content on social media. Each mission specifies the conditions for earning points, which vary depending on the nature of the action to be completed. Points will only be awarded when all the conditions defined in each mission have been successfully completed.

For content-type assignments, a preliminary validation or invalidation is performed before publication for moderation reasons. This step verifies that the submitted content corresponds to what was requested. In the event of non-compliance, the assignment may be invalidated. The user will then have the option to redo the assignment and submit new, compliant content.
Guarantee. Subject to any mandatory legal and regulatory provisions in force, no guarantee, express or implied, is granted to the beneficiary of the Account.

AKCP is thus exempt from any liability for the direct or indirect consequences of any malfunctions of the Club or its termination or closure, whatever the cause.

BENEFITS - The points or benefits obtained within the Club are
strictly personal and cannot be transferred by the beneficiary of the Account, exchanged, split and are neither compensable nor refundable.

UNSUBSCRIBE - Club membership does not require renewal. Unsubscribes can be made upon request by the Account holder, either in-store or by contacting us at the following email address: contact@adelineklam.com. Unsubscribing will result in the deletion of account data and the loss of earned but unused loyalty points, without any compensation.

PERSONAL DATA - Information concerning the beneficiary is subject to computer processing. It is collected by the company AKCP via the LOYOLY Application managed by the company Aura Corp, 4 Rue Voltaire Le Palace, Nantes, 44000 France for the purposes of Club management. Generally, it is also used by our internal services for the proper processing of your orders, deliveries, invoices and to strengthen and personalize communication and product offers reserved for our customers. We undertake not to communicate, transfer or resell your personal information to a third party. In accordance with the Data Protection Act of January 6, 1978, you have the right to access, rectify, and delete your personal data. To do so, simply send us a request online at contact@adelineklam.com or by mail (54 boulevard Richard Lenoir, 75011, Paris) indicating your last name, first name, and address.

MODIFICATION(S) OF THESE GENERAL TERMS AND CONDITIONS OR CANCELATION OF THE CLUB - AKCP reserves the right to modify these general terms and conditions or to cancel the Club at any time. Information will then be posted in advance in the store and on www.adelineklam.com . Account holders who have provided their email address will also be notified by email. Any changes to or deletion of the Club will not entitle the holder to compensation or reimbursement, which the beneficiary expressly accepts.
